The federal Fair Labor Standards Act (FLSA) turned 70 years old in 2008. Although the modern working world is completely different from that of 1938, the FLSA's requirements have changed little and remain strict and unforgiving. This dangerous combination has spurred an unprecedented explosion of wage-hour lawsuits. In the last five years,  individuals and large groups of current and former employees have filed almost 25,000 FLSA lawsuits across the U.S. against employers of all sizes.  This trend is continuing in 2009, especially in light of the weak economy.

When it comes to FLSA compliance, being "close" is not enough.  Likewise, an employer's "extra efforts" to make sure it's employees are well compensated may make matters worse if the employer is not in full compliance with the FLSA.  For these reasons, employers should immediately evaluate whether their compensation practices are fully in compliance with the FLSA and any other applicable wage-hour laws.
